TIETOKONEAVUSTEISEN OPISKELUN SÄÄNNÖT
Lukekaa huolellisesti seuraavat määräykset ja ehdot ennen tietokoneavusteiseen opetukseen osallistumista!
Nämä säännöt koskevat opiskelijan oikeutta käyttää oppilaitoksen hänen käyttöönsä tarjoamia tietokoneavusteisen opetuksen oppimateriaaleja ja oppilaitoksen oikeutta käyttää opiskelijan tällaisessa opetuksessa valmistamia aineistoja. Rekisteröityessään ensimmäisen kerran oppilaitoksensa tarjoaman verkko-opetuksen tai muun tietokoneavusteisen opintojakson opiskelijaksi, opiskelija sitoutuu noudattamaan näitä sääntöjä kaikessa oppilaitoksensa tarjoamassa tietokoneavusteisessa opetuksessa. Tietokoneavusteisella opetuksella tarkoitetaan tässä verkko-opetusta ja kaikkea muuta sellaista opetusta, mukaan lukien lähiopetus ja itseopiskelu, jossa opiskelija saa käyttöönsä tietokoneella luettavaan muotoon tallennettua oppimateriaalia.
Näiden sääntöjen lisäksi tietokoneavusteisen opetuksen järjestämisessä noudatetaan oppilaitoksen tutkintosääntöä.
1. Opiskelijan opiskelun aikana valmistaman aineiston käyttö
Opiskelija suostuu siihen, että oppilaitos saa käyttää opiskelijan valmistamaa aineistoa sen opintojakson opetuksen yhteydessä, jolle opiskelija osallistuu. Aineistosta saadaan valmistaa kopioita millä tahansa tavalla ja sitä saadaan esittää, näyttää ja välittää kyseisen opintojakson opetuksen yhteydessä. Aineistoista tehtyjä tulosteita ja muita kopioita voidaan levittää kyseisen opintojakson opetukseen osallistuville opiskelijoille ja aineisto saadaan saattaa tietoverkon välityksellä heidän saataviinsa. Aineistoa saadaan kuitenkin käyttää vain siinä laajuudessa kuin opetuksen toteuttaminen edellyttää.
Oppilaitoksen käyttöoikeus koskee vain sitä aikaa, jonka opiskelija opiskelee kyseisellä opintojaksolla. Oppilaitos ei saa esittää, levittää, näyttää tai muutoinkaan käyttää opiskelijan aineistoa minkään muun opetuksen yhteydessä eikä lainkaan hänen opiskelunsa päätyttyä. Jos oppilaitos haluaa käyttää opiskelijan aineistoa muualla, oppilaitos tekee siitä opiskelijan kanssa erillisen, kirjallisen sopimuksen. Oppilaitos saa kuitenkin säilyttää opiskelijan aineiston niin pitkään ja käyttää sitä sillä tavoin kuin on tarpeen opintosuoritusten arvioimiseksi.
2. Oppilaitoksen tarjoaman oppimateriaalin käyttö
Opiskelija sitoutuu kunnioittamaan hänen käyttöönsä tarjotun oppimateriaalin tekijöiden oikeuksia opetuksen aikana ja myös sen päätyttyä seuraavan käytännön mukaisesti.
Opiskelijalla on opetuksen aikana oikeus:
- tallentaa oppimateriaalia tietokoneen muistiin, tietolevykkeelle tai muulle alustalle (esim. CD-ROM-levylle) sekä digitaalisessa että analogisessa muodossa,
- valmistaa oppimateriaalista paperi- ja muita tulosteita,
- valmistaa oppimateriaalista varmuuskopioita,
- muunnella oppimateriaalia ja yhdistellä sitä muuhun aineistoon,
- hyödyntää muunnelmia samalla tavoin kuin alkuperäistä oppimateriaalia,
- esittää ja näyttää oppimateriaalia ja sen muunnelmia opetuksen yhteydessä,
- levittää oppimateriaalista valmistettuja tulosteita muille samaan opetukseen osallistuville sekä
- saattaa oppimateriaalia muulla tavoin samaan opetukseen osallistuvien saataville opetukseen liittyvien
tehtävien täyttämiseksi (esim. ryhmätyötilanteissa).
Opiskelijalla on oikeus hyödyntää oppimateriaalia vain tietokoneavusteiseen opetukseen liittyvässä opiskelukäytössä. Jos hän tarvitsee materiaalia muuhun käyttöön, hänen tulee hankkia siihen oppilaitokselta erillinen, kirjallinen lupa.
Opiskelijalla on velvollisuus mainita oppimateriaalia hyödyntäessään oppimateriaalin tekijä ja muut lähteet hyvän tavan mukaisesti sekä sisällyttää aineistoon alkuperäismateriaalissa olevat oikeudenhaltijamerkinnät ja tekijänoikeuksien hallinnointitiedot.
Jos oppimateriaali sisältää konekielissä muodossa olevan tietokoneohjelman (ns. objektikoodin), seuraavat toimet eivät ole sallittuja ilman ohjelman oikeudenhaltijan etukäteen antamaa kirjallista lupaa, paitsi siltä osin kuin pakottava lainsäädäntö sen mahdollistaa:
(a) ohjelman kääntäminen lähdekielelle tai ohjelman purkaminen tai muuttaminen ihmiselle tulkittavaan muotoon,
(b) ohjelman muuttaminen, uusien versioiden tai johdannaisteosten luominen,
(c) ohjelman yhdistäminen muuhun ohjelmaan,
(d) ohjelman alilisensiointi, vuokraus, vuokrasopimuksen tekeminen, lainaus tai ohjelman tai sen osan kaikenlainen jakelu joko sellaisenaan tai muutetussa muodossa, ja
(e) ohjelman käyttö tai kopiointi muuhun kuin opetuksen aikaiseen opiskelutarkoitukseen.
Opiskelijan tulee säilyttää saamaansa käyttäjätunnusta ja salasanaa huolellisesti ja huolehtia siitä, etteivät ne joudu kolmannen haltuun. Opiskelija vastaa käyttäjätunnuksellaan ja salasanallaan tapahtuvasta oppimateriaalin käytöstä. Opiskelija vastaa myös niistä vahingoista, joita oppilaitokselle aiheutuu siitä, että hän käyttää oppimateriaalia tämän sopimuksen vastaisesti.
Näiden sääntöjen lisäksi oppimateriaalin tai sen osan käyttöä voivat rajoittaa ulkopuolisen tekijän asettamat käyttöoikeusehdot. Ehdot, jotka on saatettu opiskelijan tietoon, sitovat opiskelijaa eikä hän saa käyttää oppimateriaalia ehtojen vastaisesti.

REGULATIONS FOR COMPUTER-ASSISTED LEARNING
Please read through the following terms and conditions carefully before participating in computer-assisted teaching!
These regulations concern the student's rights to use the teaching material provided to him or her by the educational institution as part of computer-assisted teaching, and the educational institution's right to use material prepared by the student during such teaching. When registering for the first time as a student of the educational institution's online teaching or some other computer-assisted course, the student undertakes to follow these regulations in all computer-assisted teaching carried out by the educational institution. Computer-assisted teaching refers to online teaching and all other teaching, including classroom teaching and private study, in which the student receives teaching material stored in computer-readable format.
In addition to these regulations, the educational institution's examination regulations shall apply to computer-assisted teaching.
1. Use of Material Compiled by the Student during the Course of his/her Studies
The student agrees to allow the educational institution to use material compiled by him or her in connection with the teaching of the course in which the student is participating. Copies of any kind may be made from the material and presented, displayed and distributed during teaching. Printouts and other copies may be distributed to students participating in the course, and the material made accessible to participants over the information network. However, such material may be used only to the extent required for teaching.
The educational institution's usage rights apply only to the period during which the student participates in the course in question. The educational institution may not present, distribute, display or in any other way use the student's material in connection with any other teaching, nor after the student has completed his or her studies. Should the educational institution wish to use the student's material elsewhere, the institution shall draw up a separate, written agreement with the student. The educational institution may store the student's material for as long as it deems this necessary to the evaluation of the student?s performance.
2. Use of Teaching Material Provided by the Educational Institution
The student shall honour copyrights associated with material provided both during and after the course based on the following practices:
During teaching, the student shall be entitled to:
- save the teaching material on a computer hard drive, disc or other platform (e.g. CD-Rom) both digitally and analogically,
- prepare paper printouts and other copies of the teaching material,
- create back-up copies of the teaching material
- amend the teaching material and combine it with other material,
- make use of the amended versions in the same way as the original teaching material,
- present and display the teaching material and its amendments in conjunction with the teaching,
- distribute printouts of the teaching material to other students participating in the course, as well as
- distribute the teaching material in any other way to participants on the same course for the completion of tasks connected to the teaching (e.g. group work).
The student shall be entitled to use the teaching material only for study purposes related to computer-assisted teaching. Should the material be required for other purposes, the student must acquire separate, written consent from the educational institution.
The student shall be obliged to name the Supplier of the teaching material and other sources in accordance with good practice and to include notice of copyright and administrative copyright information as stated in the original when making use of the teaching material.
Should the teaching material include software in machine code format (so-called object code), the following shall not be permitted without advance permission in writing from the copyright holder of the software, unless required by the legislation in force:
(a) translation of the software into the source language or decoding or transforming the software into a readable format,
(b) amending the software, creating new versions or derivatives of the software,
(c) integrating the software with other software,
(d) sub-licensing or leasing of the software, drawing up a lease agreement, lending or any distribution of the software or its parts as such or in altered form, and
(e) using or copying the software for any purposes other than study during the teaching of the course.
The student must carefully store any username and password issued to him or her and ensure that they do not come into the possession of a third party. The student shall be liable for the use of study material bearing his or her username and password and for any damage caused to the educational institution should the student use the material in any way other than that permitted under this contract.
In addition to the above regulations, the use of the teaching material or its parts may be limited by conditions stipulated by an external supplier. The terms and conditions presented to the student are binding, and he or she may not use the teaching material contrary to the said terms and conditions.
